Must admit I don't see Love and Theft this way. Could you maybe point out a few examples of songs in the album that you think fit that description and I'll have a closer listen to see if I can interpret it your way?

I think Tempest is the creepiest album, it's extremely dark and sinister in places.

To my mind, Sugar Baby is the only song on the album that actually has an atmosphere that befits its cold existential lyrics.

I'd say that some of the themes (though not the music) of songs like Mississippi and High Water speak to a level of "spookiness" in the album too.

I could totally imagine a slower, more Lanois-ian re-arrangement of Mississippi that hangs on lines like:

Walking through the leaves, falling from the trees
Feeling like a stranger nobody sees

or

Well my ship's been split to splinters and it's sinking fast
I'm drowning in the poison, got no future, got no past

or

Well, the emptiness is endless, cold as the clay
You can always come back, but you can't come back all the way
