The Second U.S. Circuit Court of Appeals in New York ruled today that artist Richard Prince did not violate the copyright of another artist when he incorporated photographs of Rastafarians (taken by artist Patrick Cariou for his book on Rastafarian culture) into a series of paintings and collages. Prince incorporated a number of the photographs into his show "Canal Zone" in 2007-2008. Some of the works in "Canal Zone" sold for millions of dollars, but their exhibition and resale was embargoed as the copyright case went through local court (where Prince lost) and now appeals court. A lower court had ruled there was a copyright violation and ordered Prince to turn all of the relevant artwork over to Patrick Cariou. Prince's gallery, Gagosian, was a partner in the lawsuit, which has been greeted by artists, art historians and curators as a victory for the art world as well as for Richard Prince.
